We are all Nikolina: Informer violated multiple laws and provisions of the Journalists' Code.

The Association of Independent Electronic Media (ANEM) strongly condemns the airing of a photograph of student Nikolina and the commentary surrounding it on the Informer television program, deeming this action by the editor-in-chief of that media outlet, Dragan J. Vučićević, as unprofessional, unacceptable, contrary to all ethical standards, and in violation of the laws of the Republic of Serbia.

The public display of intimate photographs without the consent of the individual is prohibited by the Criminal Code under Articles 144 and 145.

Additionally, ANEM draws attention to the fact that this action violates several provisions of the Code of Journalists of Serbia related to privacy, dignity, malicious damage to a person's reputation, and the use of honorable means.

The Ministry of Information and Telecommunications was obligated to act ex officio based on the Law on Public Information and Media and the Law on Electronic Media, as the photographs were not only displayed unlawfully by the individual depicted in them, but were also taken when Nikolina was a minor.

According to the Law on Electronic Media, the Regulatory Body for Electronic Media (REM) should have acted, as they issued a broadcasting license to TV Informer.

Considering that Information Minister Boris Bratina appeared on the aforementioned television yesterday using inappropriate language, it is hard to expect that he will enforce the law for which the ministry he leads is responsible.

We do not expect any reaction from REM, not because a new Council has not been elected, but because the power of the majority owner of TV Informer surpasses that of any regulator.

For this reason, we are all Nikolina, and not just verbally, but through our daily struggle for a society where such behavior will be defined as the most serious crime, and where such actions will not occur to anyone. Especially since the adoption of provisions criminalizing revenge pornography is being announced, which will likely remain a dead letter on paper if there is no response to such drastic cases of abuse of intimate recordings.

ANEM calls on journalists and media to not only respect the Code and laws, but also to universally condemn what Informer has done and broadcast.
